Court blocks Nakuru county’s attempt to reclaim hospital land

The Nakuru County Government has lost its bid to reinstate a gazette notice revoking the War Memorial Hospital land lease.

This follows a ruling by the Court of Appeal, which dismissed the county’s appeal against an earlier decision by the Environment and Land Court in Nyandarua that quashed the gazette notice cancelling the hospital’s certificate of lease.

Court of Appeal Judges Mohamed Warsame, John Mativo, and Mwaniki Gachoka, in a ruling delivered on Friday, ruled that the judgement by the lands court does not in any way adversely mention or affect the county government.

They noted that the application the hospital sought orders for was triggered by the decision of the land registrar’s publication of Gazette Notice No. 6309 dated May 19, 2023, cancelling the hospital’s certificate of a lease for the suit land on the ground that it had been issued erroneously.

“We do not see finding adversely affecting the 1st respondent (County Government) in the above orders,” read the ruling by the appeal court judges.
